No Longer A Nation of Law

“Congress will not act, so I will,” warned President Obama over the past few weeks as he projected the possibility of acting unilaterally on the issue of illegal immigration. And act, he did.
In an announcement Thursday evening, the President granted amnesty to millions of those who have entered the country illegally. Those granted amnesty, are those who have been in the country for at least five years, have children who are citizens or legal residents, who pass a criminal background check, and are willing to pay taxes and register with the government. The impact could include as many as 6 million people.
The elements of his plan have merit, but to be legal, the proposal must be enacted legislatively, which he could have done easily when his party controlled both chambers of congress during his first term. What he proposes to do is to rewrite U.S. immigration law without the Constitutional or statutory authority to do so.
His actions stand in stark contrast to what he has been saying over the past six years. On March 28, 2011 in a Univision appearance, he declared, “For me to simply through executive order ignore those congressional mandates, would not conform to my appropriate role as president.”
On July 25, 2011, he stated, “I know some people want me to bypass congress and change the laws on my own. But that’s not the way our system works.”
On November 25, 2013, he declared, “If in fact I could solve all these problems without passing laws in congress, then I would do so. But we’re also a nation of laws.”
On March 6, 2014, he clarified, “I cannot ignore those laws anymore than I can ignore any of the other laws on the books. What I said in the past remains true. Until congress passes a new law, then I am constrained in terms of what I am able to do.”
On February 14, 2013, he said, “The problem is that, I’m the president of the United States. I’m not the emperor of the United States. My job is to execute the laws that are passed.”
Then, in reference to his 2012 Executive Order where elements of the stalled Senate Dream Act were implemented, he said, “What we have tried to do is administratively reduce the burdens and hardships on families being separated. And what we’ve done is, obviously, pass the deferred action which made sure that the DREAMers, young people who were brought here and think of themselves as Americans, are American except for their papers, that they’re not deported.
“Having said all that, we’ve kind of stretched our administrative flexibility as much as we can. And that’s why making sure we get comprehensive immigration reform done is so important.”
And on January 30, 2013, he told Univision, “Well, I think it is important to remind everybody that, as I said I think previously, and I’m not a king. I am the head of the executive branch of government. I’m required to follow the law.”
In fact, there are at least 25 times the president has expressed those convictions, and are captured on video. His comments focus on three key areas: 1) we are a nation of laws; 2) as president, he hasn’t the authority to make law, for that’s the role of the legislative branch; and 3) he is not a king or an emperor, i.e. a despot. Clearly, from his speech on Thursday, those convictions have changed. He either feels he is above the law, can now make law, subordinating congress to irrelevancy, or he feels he is now king or emperor.
The Executive Order (EO) does not grant the president the authority to do what he said he’d do this week. There are three things the EO can be used for: operational management of the executive branch, operational management of the federal agencies or officials, and implementing statutory or constitutional presidential responsibilities. Executive Orders cannot be used to either create new law, or to annul or reverse existing law. After all, his primary function, according to the Constitution and his oath of office, is to “faithfully execute the office” in enforcement and execution of the laws legally passed by the legislative branch.
Many have cited executive order precedence of prior presidents. Those situations were far different. President Ronald Reagan signed the Immigration Reform and Control Act in 1986, which granted limited amnesty to some qualified illegal immigrants. He subsequently issued an executive order that included minor children of those specifically covered under the Act.
In 1990, President George Herbert Walker Bush issued an Executive Order related to that Act that broadened the scope to include spouses and children of those granted amnesty under the Simpson-Mazzoli Act. The EO was a logical inclusion not specifically delineated in the Act. Both Reagan’s and Bush’s Executive Orders were supported by the legislative intent of Simpson-Mazzoli, were legal declarations of how Simpson-Mazzoli would be implemented, and were supported by Congress.
What the President did this week establishes a dangerous precedent and arguably creates a constitutional crisis over the separation of powers between the legislative and executive branches and the rule of law. As disturbing as it is to have a president so willfully and intentionally exceed his constitutional authority, is the fact that his party leadership is entirely supportive of his illegal actions.
In a few years there will be a Republican president who may, using his “pen and his phone,” rescind the Affordable Care Act, or outlaw abortions altogether, or initiate tax cuts just by Executive Order. Those who have no problem with what the President did this week will have no legal leg to stand on in their denunciation of such future executive actions.
Regardless of which party he hails from, and regardless of the viability of his proposal, President Obama this week declared that we are no longer a nation of laws, and that he is our emperor.

Based on his own words, we are now no longer a nation ruled by law, but by fiat, and he is the emperor.
I see. Since Obama said that he is not an emperor, then that is so. If he said that he would close Guantanimo, he will succeed in doing it. If he said that the we are a nation of laws, then we are — but with some exceptions.
But we both know that executive orders ARE, in fact, legal. He tried to get Congress to fix the broken immigration, but nothing he did succeeded, so a legal order, similar to what other Presidents have done was issued. He sought a bipartisan immigration fix, and such a bill passed the Senate 1 1/2 years ago, but Bohner refused the bipartisan bill and refused to bring it on the floor till he had full support of only his side of the House.

Indeed we need immigration reform, the emperor hasn’t enforce the immigration laws for how many years now and now writes an Executive order that doesn’t cover a single law written and we’re just supposed to sit back and enjoy the ride. Yes, we are.
Executive Orders indeed are legal but only if they’re covering a legal law. Time to deport how many millions of people who are here illegally. But we can’t break up families even if the illegals do it all the time?

The bill passed by the Senate (the one that Bohner didn’t want to pass) provided about 50 Billion dollars to tighten enforcement of our borders. It would double the number of U.S. Border Patrol agents along the southern border and require the construction of 700 miles of fencing there. It also would place new burdens on employers, who would be required to check the legal status of all job applicants using the government’s E-Verify system.
I suspect that Bohner didn’t WANT to fix the problem till he could get credit for it somehow.
Thayne, I’d strongly suggest you actually read the piece, for it cites the legal foundation for executive orders, and how previous presidents have used it contextually with regard to specific statute. Obama basically created new law by his declaration.
To provide further context, think about it this way. Also, with regard to “deportations,” the Obama administration changed the definition to include those who are simply turned away at the border. Those are not definitionally or technically deportations, but it surely makes their numbers look good.

First of all one must consider what an Executive order of proclamation is: it is not a law, but is often treated as one. Organizations under the president are often affected by them. Are they legal? yes!

Obama’s actions much more resemble Truman’s attempted steel companies seizure in the 50s. In Youngstown Sheet & Tube Co. v. Sawyer, the Supreme Court found that the President had acted without statutory or Constitutional authority, and his EO was struck down.

Are they legal?
Depends. The way Obama abuses the process and writes laws that wouldn’t pass muster or get past the electorate, then No, his kind aren’t legal and never will be.
He’s fixed immigration? Seems he broke it by failing to deport roughly 20 million people who are here illegally. Estimated 300,000 here voted for him, they got on the Spanish channel and crowed about it but they were telling a fib, right?
No, he abuses Executive Orders to get things that no one would approve us, let along the citizens of the U.S. that elected people to write laws to cover what needs to be covered. The immigration laws already exist, ENFORCE THEM.
But then wonderful Mr. Putz, the Hairy Reid sits on anything that comes the way of the Senate. Hopefully that changes come Jan. 1st. What’s Reid going to do then, write his own executive order? Probably, he can find it in his ‘version’ of the constitution. The same one Obama finds his dictator powers in.
Congress has passed laws, lots of them and they sit and go nowhere thanks to Harry, The Putz Reid. If I could excommunicate that dude, I’d do it in a heartbeat. He give humans a bad name.
One could imagine Bush Jr. making a similar move in issuing this type of executive action. Conservatives would certainly be less critical, but Liberals would be screaming for revolution.
Obama will not seal the borders and will not let any one else. The sheriff in Arizona, was enforcing the laws on the book, Obama and Home Land Security told him to back off!
And NO! Birth Certificate should be issued to babies of illegal immigrants, no legal papers NO! Birth Certificate!

I was visiting with some LDS relatives this past weekend. They are involved in leadership for Spanish-specking wards and branches in Provo. They said that support for Obama’s action is overwhelming. The church has been an accomplice in knowing about undocumented immigrants, by calling those youth on local missions, and not informing the authorities.

I agree the checks and balances of our Constitutional form of government have been violated via executive order.
Executive Order is a result of a House of Representatives and Senate where the legislative process is not expedient to resolving an issue; or when Congress fails to act despite proposals to do so by its own members who are held hostage by party leadership.
While two wrongs don’t make a right, Obama’s action is a result of Congressional failure by both parties which contributes to the erosion of the Constitution as well.
Congress routinely delegates or absolves itself of a good amount of lawmaking by ceding to the executive departments and agencies who make the bureaucratic rules that have the same force and effect as law. There is plenty of argument this level of Congressional delegation to the Executive Branch is likewise unconstitutional.
Whether we are talking about needed Comprehensive Immigration Reform, Infrastructure Funding, Tax Reform, or Healthcare Reform, no legislation is allowed an up or down vote in either chamber within our current Congress.
When was the last time Congress passed a budget instead of allowing the government to operate via continuing resolutions?
When was the last time Congress has fulfilled its responsibility under the War Powers Act as opposed to delegating responsibility to the Executive Branch?
Harry Reid as majority leader refuses to allow the Senate to vote on anything. John Boehner as Speaker likewise has refused to allow the House of Representatives to vote on a bill passed in the Senate regarding Immigration.
Each legislative body only seeks to be an obstructionist to the other rather than conduct up or down votes and then conference on the respective bills passed in each body to achieve sending passed legislation to the President. That is how it is supposed to work.
Congressional leadership from both parties are obstructionists which has made the Executive Order route attractive to Obama and will continue to be attractive to future presidents unless the Legislative Branch starts fulfilling its responsibilities.
I agree with ike that if a Republican president were to have issued an EO like Obama has done, it would be the Democrats flopping like carp on a dock with Republicans taking a posture of rationalization similar to what the Democrats are currently dedicated in defense of Obama.
Republicans and Democrats in Congress need to dump their leadership that are obstructionists who seek to absolve themselves and their party of the hard choices that need to be made.
The status quo is lawmaking via Executive Order and Litigation because Congress refuses to do its job.

Spanish-specking wards? We have one of those specking wards here. Last time I attended it was sad, don’t ask. Less than a 100 members with about 20+ active, surrounded by 8 wards that have around 400+ members of about 60% activity wards and more Hispanic members than the Spanish branch does. Reason for it being in existence? They speak only Spanish there. It’s a saving grace in their world.

Now 45 years ago the local sheriff escorted 2 missionaries to the county line because they had no means of support (job?) and we sent in 10+ pairs to replace them and he gave up. Wonder what he’d do about the ILLEGALS here now who are on Welfare/Food Stamps/Sec. 8 the whole ball of wax? 500 new students that are ILLEGAL showed up first day of school here. They speak Spanish but can’t read or write in Spanish. Parents pay ZERO school tax, we pay for them including bi-lingual teachers because they refuse to speak English. Reported to every authority in the place and Obama says we have to pay for them no choice. It’s like the Obama meal at McDonalds, they order, citizens pay for them.

We just got lectured on ‘justifiable anger’ this morning by what’s his name?
Seems if we go into a store and steal cigars and use them to smoke your pot in and in the process of stealing them you beat up a clerk half your size, that’s justifiable anger at it’s finest.
Then you go outside and walk down the middle of a busy thoroughfare and when a policeman tells you to get out of the road you call him a vulgar name and try to get his gun away from him. That kind of justifiable anger? More like going psychotic in the world of a pot head. Or suicide by cop as those who have seen it before call it.
What’s justifiable anymore makes no sense to anyone but those who abuse the civil laws and form mobs to steal/rob and pillage. And then justify it because…???? Just read an article that all of the businesses burned yesterday were ‘minority’ businesses. But they had insurance, right?
MLK and LBJ are turning over in their graves. All the hard fought for civil rights are being abused and lost. The 1960s were for naught.

I am posting it here because I found this man’s message to be in keeping with my own thoughts about the events going on in Ferguson. It’s lengthy, but worth reading. I wanted to clear up a few black and white questions and answers. The things I state are facts. They are not downloaded from some media website, not propaganda, just observations from a 83 year old black man, born in America:
“I was told by my parents (yes, a married man and woman with my last name), that I was a n*****. We lived in “N***** Town” in a small Texas town, no A/C, grass growing through the floor, no car, no TV. We washed our bodies with lye soap that my mother made, by hand. I thought I was a n*****, until I graduated high school, went to college, did an enlistment in the Army, and got a job. I am now retired, own my own home, have 6 children by ONE WOMAN, and we all have the same last name. I have a Bachelor’s Degree in Liberal Arts, a Master’s Degree in Sociology. My retirement, VA disability from combat in the Korean War (I only have one leg), and part-time pay in a local college, is about $125,000 a year. From dirt poor n*****, to old, black, proud American.
Yes, I am black, and I can say “n*****”, because I understand the true meaning of the word.
Let’s clear up a few things about the Michael Brown incident.
-Fact: It is not called “shoplifting or stealing”, it’s called “robbery”, which is a felony. Brown stole something and assaulted someone, that means ROBBERY. It’s on video, and it’s a fact. Not shoplifting, not theft, not “lifting” a few cigars, but ROBBERY!
-Michael Brown, like Trayvon, was portrayed by the media as a “little black boy”, cute little headphones, and his cap and gown photo, gunned down by a ruthless police assassin, executed by “whitey”. First, I have never seen a cop drag a person into their car’s driver door to arrest them. So, let us be clear, Michael Brown was a n*****; a sorry assed, criminal, hoodlum, n*****. Nobody wants to say that, but I will. He had a criminal record a mile long, was known for numerous assaults, robberies, including the one you saw with your own eyes, and still refuse to call it a robbery. He was, like so many others, living a life that he thought he was “entitled” to, just for being alive. Gangsta rap, weed, drinking, guns, and those stupid-assed low profile rims, makes him some kind of bad-ass n*****.
-I have fought communist Chinese and North Korean soldiers in the 1950’s with more honor than that n*****. Yep, I peeled potatoes and shot communists. That’s the only job a n***** soldier could get.
Rodney King? Black Riots!
Trayvon? Black Riots!
-Hurricane Katrina? Black Riots! Stealing TV’s, designer clothes, etc.
-O.J. Simpson kills white man and white woman, found NOT GUILTY? Did white folks riot? Nope!
-In fact, when is the last time white people rioted? Civil War, maybe? That’s because they are, relatively, civilized people, much like many black Americans. Protesting is one thing, hell, I’m all for it. Even if you are an ignorant idiot, you have a right to protest.
-Stop only showing the young black “cap and gown” photos of Michael. Charles Manson may have a few of those laying around, as well. Show the n***** “gangsta” photos of the “poor unarmed teenager” (grown man) pics that have been removed from his Facebook page, holding the loaded pistol, smoking weed, with a mouthful of money.
-Militarization? The stupid-assed media that publicizes this has no idea what “militarization” really is. Cops wear helmets and vests, and drive armored vehicle because unemployed n*****s thrown bricks at them, moron! You put on an “Adam 12″ uniform and walk down the streets of Ferguson during the criminal riots. I can guarantee that you’ll jump into the first armored “military tank” that you see.
-You only “want the police” when you “need the police”, otherwise, you mock and fear what you do not understand about the police. And by the way, the police are trained to take your shit, but I wouldn’t fuck around with those Army National Guard, they aren’t as well disciplined “culturally” to take your shit like police do every day. They will ventilate your black asses with M-16s, with military precision and extreme prejudice.
-And finally, the way we protest and demand justice, is run down the streets breaking shit, looting stores, and acting like a bunch of untrained monkeys? Hell, after Rodney King, criminal n*****s were actually killing people, thinking they were entitled to be worse criminals than they already were. I will not be around long. While my mind is still sharp, and my aim is still good, my body is eating away with cancer. It started in the prostate, and is spreading rapidly. After I die, I have asked my children to publish my writings, and include my name. Although I am not expecting any miracles, I can only hope that Americans will stop blaming color, start blaming criminals, and see people for what the they really are.
